21 WHEREAS, the imposition of a Fire Rescue Assessment for fire rescue services,
22- facilities, and programs each fiscal year is an equitable and efficient method of allocating and
F3 apportioning the Fire Rescue Assessed Cost among parcels of Assessed Property; and
24. WHEREAS, the City Commission desires to continue a Fire Rescue Assessment
25 program and impose a Fire Rescue Assessment in the City using the procedures provided by thL.
26 Ordinance, including the tax bill collection method, for the Fiscal Year beginning on October 1,
27 2013; and
28 WHEREAS, the City Commission, on July 1, 2008, adopted Resolution No. R08-076
29 (the "Initial Assessment Resolution"); and
30 WHEREAS, the City Commission, on July 23, 2013, adopted Resolution No. R13-067
31 (the "Preliminary Assessment Resolution"), which set forth the preliminary assessment rates for

I Fiscal Year 2013 -14, and which contains and references a brief and general description of the
2 fire rescue services, facilities, and programs to be provided to Assessed Property; describes the
3 method of apportioning the Fire Rescue Assessed Cost to compute the Fire Rescue Assessment
4' for fire rescue services, facilities, and programs against Assessed Property; confirmed the rates
5 of assessment; and directs the updating and preparation of the Assessment Roll and provision of
6 the notice required by the Ordinance; and
7 WHEREAS, in order to impose Fire Rescue Assessments for the Fiscal Year beginning
8 October 1, 2013, the Ordinance requires the City Commission to adopt a Final Assessment
9 Resolution, which confirms and establishes the rates of assessment, and approves the
10 Assessment Roll for the upcoming Fiscal Year, with such amendments as the City Commission
11 deems appropriate, after hearing comments and objections of all interested parties; and
12 WHEREAS, the Assessment Roll has heretofore been made available for inspection by
13 the public, as required by the Ordinance; and
14 WHEREAS, notice of a public hearing has been published and mailed, as required by
15 the terms of the Ordinance. An Affidavit of Mailing being attached hereto as Appendix A and
16 the Proof of Publication being attached hereto as Appendix B; and
17 WHEREAS, the City Commission recognizes that the special assessment may work a
18 hardship on certain residential property owners in the City, and desires to continue to provide a
19 means whereby affected property owners may request a total or partial waiver of the special
20 assessment for hardship; and
21 WHEREAS, a public hearing was held on September 12, 2013, and comments and
22 objections of all interested persons have been heard and considered as required by the terms of
23 the Ordinance.

8 SECTION 2. DEFINITIONS AND INTERPRETATION. This resolution
9 constitutes the Final Assessment Resolution as defined in the Ordinance. All capitalized words
10 and terms not otherwise defined herein shall have the meanings set forth in the Ordinance, the
11 Initial Assessment Resolution and the Preliminary Assessment Resolution.
12 SECTION 3. IMPOSITION OF FIRE RESCUE ASSESSMENTS.
13 (A) The parcels of Assessed Property described in the Assessment Roll, which is
14 hereby approved, are hereby found to be specially benefited by the provision of the fire rescue
15 services, facilities, and programs described or referenced in the Preliminary Assessment
16 Resolution, in the amount of the Fire Rescue Assessment set forth in the Assessment Roll, a
17 copy of which was present or available for inspection at the above referenced public hearing and
18 is incorporated herein by reference. It is hereby ascertained, determined, and declared that each
19 parcel of Assessed Property within the City will be specially benefited by the City's provision of
20 fire rescue services, facilities, and programs in an amount not less than the Fire Rescue
21 Assessment for such parcel, computed in the manner set forth in the Preliminary Assessment

22 Resolution. Adoption of this Final Assessment Resolution constitutes a legislative
23 determination that all parcels assessed derive a special benefit in a manner consistent with the
24 legislative declarations, determinations and findings as set forth in the Ordinance, the
25 1 Preliminary Assessment Resolution, and this Final Assessment Resolution from the fire rescue

I services, facilities, or programs to be provided and a legislative determination that the Fire
2 Rescue Assessments are fairly and reasonably apportioned among the properties that receive the
3 special benefit as set forth in the Preliminary Assessment Resolution.
4 (B) The method for computing Fire Rescue Assessments described and referenced in
5 the Preliminary Assessment Resolution is hereby approved. The Parcel Apportionment
6 methodology described in Appendix F of the Preliminary Assessment Resolution, and adopted
7 in Section 7 of the Preliminary Assessment Resolution, is hereby approved.
8 (C) For the Fiscal Year beginning October 1, 2013, the estimated net Fire Rescue
9 Assessed Cost to be assessed is $5,809,640.00. The Fire Rescue Assessments to be assessed and
10 apportioned among benefited parcels pursuant to the Cost Apportionment and Parcel
11 Apportionment to generate the estimated Fire Rescue Assessed Cost for the Fiscal Year
12 commencing October 1, 2013, are hereby confirmed and established as follows:

14 (D) The above rates of assessment are hereby approved. Fire Rescue Assessments
15', for fire rescue services, facilities, and programs in the amounts set forth in the Assessment Roll,
16 as herein approved, are hereby levied and imposed on all parcels of Assessed Property described
17 in such Assessment Roll for the Fiscal Year beginning October 1, 2013.
18 (E) As authorized in Section 2.14 of the Ordinance, no Fire Rescue Assessment
19 shall be imposed upon a parcel of Government Property, except as provided in the Preliminary
20 Assessment Resolution, or upon a parcel of Institutional Property whose use is wholly exempt
21 from taxation under Florida law.

(F) Any shortfall in the expected Fire Rescue Assessment proceeds due to any
2 reduction or exemption from payment of the Fire Rescue Assessments required by law or
3 authorized by the City Commission shall be supplemented by any legally available funds, or
4 combination of such funds, and shall not be paid for by proceeds or funds derived from the Fire
5 Rescue Assessments.
6 (G) As authorized in Section 2.13 of the Ordinance, interim Fire Rescue
7 Assessments are also levied and imposed against all property for which a Building Permit is
8', issued after adoption of this Final Assessment Resolution based upon the rates of assessment
9 approved herein.
10, Fire Rescue Assessments shall constitute a lien upon the Assessed Property so
11 assessed equal in rank and dignity with the liens of all state, county, district, or municipal taxes
12 and other non-ad valorem assessments. Except as otherwise provided by law, such lien shall be
13 superior in dignity to all other liens, titles and claims, until paid.
14 (1) The Assessment Roll, as herein approved, shall be delivered to the Tax Collector
15 for collection using the tax bill collection method in the manner prescribed by the Ordinance.
16 The Assessment Roll, as delivered to the Tax Collector, shall be accompanied by a Certificate to
17 Non-Ad Valorem Assessment Roll in substantially the form attached hereto as Appendix C.
18 (J) No Emergency Medical Services shall be funded from the Fire Rescue
19 Assessment revenues.
21 RESOLUTION. The Preliminary Assessment Resolution is hereby confirmed.

23 Final Assessment Resolution shall be the final adjudication of the issues presented (including,

I but not limited to, the determination of special benefit and fair apportionment to the Assessed
2 Property, the method of apportionment and assessment, the rate of assessment, the Assessment
3 Roll and the levy and lien of the Fire Rescue Assessments), unless proper steps shall be initiated
4 in a court of competent jurisdiction to secure relief within 20 days from the date of this Final
5 Assessment Resolution.
7 (A) The City Commission of the City of Boynton Beach, Florida hereby continues
8 1 its program for qualified individuals who need financial assistance to pay all or part of the Fire
9 Rescue Assessment levied on their property or who seek deferral of payment of all or part of the
10 I Fire Rescue Assessment on their property.
1 (B) The City's program for financial assistance shall be commonly referred to as
12 H.E.L.P., Hardship Extension Loan Program. The following types of financial assistance are
13 available, based upon need:

5 disabled persons).

7 3. Residential Property Owners that qualify for the additional homestead
8 exemption for persons 65 and over authorized pursuant to Section
9 196.075, Florida Statutes are also eligible to apply for the Hardship
10 Waiver.

12 4. Residential Property Owners that are qualified under the Florida
13 Homestead Property Tax Deferral Act, Section 197.242, et al., Florida
14 Statutes.

15 (D) Eligible Residential Property Owners may submit an application for a Hardship
17 Waiver or Deferral, on a form prepared by the City, with the Finance Department. The
18 Application shall include the following:
19 1. Documentation demonstrating eligibility for the Hardship Waiver or
20 Deferral through one of the criteria from exemptions listed in Section C
21'I above;
22
23'' 2. A copy of the Tax Bill for the subject property;
24 3. Description of the facts and circumstances of the hardship.
25 (E) All Applications for the Hardship Waiver or Deferral must be received by the
26 City's Finance Department on or before November 1 of each year in order to be considered for
1
27 the currently billed assessment. For example, all Hardship Waiver or Deferral Applications for
28 the Fire Rescue Special Assessment for the Fiscal Year commencing October 1, 2013, must be
29 received on or before November 1, 2013.
3C (F) Once received, all applications shall be reviewed by the City's Finance Director,
31 or his or her designee ( "Reviewing Official "). The Reviewing Official shall review the facts
32 and circumstances to determine whether a hardship exists to warrant a partial or total waiver of

I the special assessment levied upon the applicant's real property or a deferral of payment of such.

I The decision of the Reviewing Official is final.

1 (G) The Reviewing Official shall render a written decision and provide such to the
5 applicant.

6 If a partial or total waiver or deferral is granted by the Reviewing Official, the
I
7 Finance Director shall ensure appropriate documentation is provided to the Tax Collector as to
8 the revised amount of the assessment as to the applicant.
9 (1) An applicant may apply for a Hardship Waiver as to one property only.
10 (J) An applicant must apply for the Hardship Waiver on an annual basis.
11 (K) A deferral may be granted for no longer than the end of the then current fiscal
12 I year.
13 (L) When financial assistance is granted pursuant to the H.E.L.P. program, any
11 shortfall in the expected Fire Rescue Assessment proceeds due to any reduction or exemption
15 from payment of the Fire Rescue Assessments authorized by this Section shall be supplemented
1 II by any legally available funds, or combination of such funds, and shall not be paid for by
17 proceeds or funds derived from the Fire Rescue Assessments.
U SECTION 7. MOBILE HOME VACANCY ADJUSTMENT. As authorized in
19 Section 4(L) of the Preliminary Rate Resolution, there shall be a Mobile Home Vacancy
20 Adjustment procedure for Mobile Home and Recreational Vehicle Park Property, using the
21 procedures established in Resolution R11 -089. Any shortfall in the expected Fire Rescue
22 Assessment proceeds due to any adjustment for vacancy shall be supplemented by any legally
23 available funds and shall not be paid for by proceeds or funds derived from Fire Rescue

I Assessments. Failure of the Owner to timely provide the information to the City will result in
2 no Vacancy Adjustment for the special assessment.
3 SECTION 8. CONFLICTS. All resolutions • parts • resolutions in conflict
10 immediately upon its passage and adoption.
