3 A RESOLUTION OF THE CITY OF BOYNTON BEACH,
4 FLORIDA, AUTHORIZING THE MAYOR TO
5 EXECUTE A QUIT CLAIM DEED TRANSFERRING
6 PROPERTY IN FAVOR OF THE EXECUTIVE
7 ESTATES OF BOYNTON BEACH HOMEOWNERS
8 ASSOCIATION, INC.; AND PROVIDING AN
9 EFFECTIVE DATE.

11 WHEREAS, on October 3, 1989, via Resolution 89 -XX and Resolution 89 -YY, the
12 City Commission abandoned Citrus Glen Drive and Citrus Avenue; and
13 WHEREAS, it has been determined that the roadways had not been properly
14 abandoned and were considered by the Palm Beach County Property Appraisers office to be
15 private parcels owned by the City; and
16 WHEREAS, it has been determined that there is no public purpose for City
17 I ownership of both Citrus Glen Drive and Citrus Avenue; therefore, in order to ensure proper
18 transfer of ownership to the Homeowners Association, City staff now recommends approval
19 of a Quit Claim Deed transferring the properties to the HOA.
201. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
21 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
22 Section 1. The foregoing "WHEREAS" clauses are true and correct and
23 I hereby ratified and confirmed by the City Commission.
24 1 Section 2. The City Commission of the City of Boynton Beach hereby authorizes
25, the Mayor to execute a Quit Claim Deed transferring ownership to the property described in
26I the Quit Claim Deed attached hereto as Exhibit "A" to the Executive Estates of Boynton
27 1 Beach Homeowners Association, Inc.
28 Section 3. That this Resolution will become effective immediately upon passage.

THIS QUIT CLAIM DEED made this day of March, 2012 between The City of
Boynton Beach, a Florida municipal corporation, whose post office address is 100 East
Boynton Beach Blvd., Boynton Beach, Florida 33435 (hereinafter referred to as "Grantor ")
and Executive Estates of Boynton Beach Homeowner's Association, Inc., a Florida non-
profit corporation, whose post office address 1500 Gateway Blvd., Suite 220, Boynton
Beach, Florida 33426 (hereinafter referred to as "Grantee "). "Grantor" and "Grantee" are used
for singular or plural, as context requires.

WITNESSETH:
That Grantor, for and in consideration of the sum of Ten Dollars ($10.00) in hand paid
by Grantee, receipt whereof is hereby acknowledged, has granted, bargained and quit - claimed
to said Grantee and Grantee's successors and/or assigns forever the following described real
property situate, lying and being in PALM BEACH County, Florida, to wit:
Those certain portions of Citrus Avenue and Citrus Glen Drive described on Exhibit
"A" attached hereto and made a part hereof
To Have and to Hold the same together with all and singular the appurtenances
thereunto belonging or in anywise appertaining, and all the estate, right, title interest, lien,
equity and claim whatsoever of Grantor, either in law or equity, for the use, benefit and profit
of said Grantee forever.
