A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
RESOLUTION NO. R94-87 and R94-196, PROVIDING
FOR AN INCREASE IN THE PROFESSIONAL SERVICES
AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH
AND ROSSI AND MALAVASI FOR ADDITIONAL
ENGINEERING SERVICES FOR THE DESIGN OF MINER
ROAD FROM LAWRENCE ROAD EAST TO CONGRESS
AVENUE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on May 17, 1994, the City Commission approved by
Resolution No. R94-87, the execution of a Contract with Rossi
and Malavasi, Engineers, Inc., for engineering services for
Miner Road; and
WHEREAS, on November 15, 1994, the City Commission approved
ResolUtion No. R94-196, which provided for the expansion of the
scope of engineering services; and
WHEREAS, Palm Beach County has requested that additional
engineering services be provided for the design of Miner Road
from Lawrence Road east to Congress Avenue, at an additional
negotiated cost of $10,550.00; and
WHEREAS, it has been determined by the city Commission to
be in the best interests of the City to expand the scope of
services for that project;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
~ The City Cormmission of the City of Boynton
Beach, Florida does hereby amend Resolution No. R94-87, and R94-
196 to encompass the expanded scope of services, attached hereto
as Exhibit "A"

immediately upon passage.

Additional Professional Services
Dear Miss Parker:
As requested by Palm Beach County the following is our proposal to provide
additional engineering services for the above referenced project. The additional design
services are beyond our contracts with the City of Boynton Beach for this project.
As discussed in our meeting on December 14, 1994 with Mr. Javier Lopez, the
current contracts with the City of Boynton Beach do not include the full extent of a
set of construction drawings as listed in the "Palm Beach County Thoroughfare Road
Design Procedures" Manual, nor does it include the requirements of Lake Worth
Drainage District for reshaping of the L-20 Canal, design of a new drainage system
for the section of road from Congress Avenue west to the existing pavement terminus
and the new ERM clearing permit application.
The existing roadway section, just west of Congress Avenue, consists of
approximately 1,800.00 L.F. of two lanes of an ultimate six lane roadway, which
have been constructed along with a temporary drainage system. This section has an
approved 24' C.AI.P. outfail culvert into the L.W.D.D. L-20 Canal with a sluice gate
for emergency situations. Water quality and quantity demands for this section are
currently being met at the undeveloped section of the road right of way.
The drainage system for the above referenced existing roadWay section,
previously designed by "Want~nan and Associates, Inc.', did not include drainage for
the ultimate roadway section. '
The owner of the remaining undeveloped section of the "Melear P.U.D.' project
has dedicated 1.00 AC. of land for drainage accommodation of the proposed Miner
Road project. Preliminary drainage computations by our office conclude that the
proposed 1.00 AC. site can address the drainage demands of the remaining portion
~.,of Miner Road, for which drainage has not been provided.
As you can see in the attached copies of the previous proposals to the City of
Boynton Beach, none of the additional design, services were included in it.

SCOPE OF WORK
This project consist of providing additional engineering services for the design
of Miner Road, from Lawrence Road east to Congress Avenue, a total of
approximately '5,250 L.F. The additional design will consist of the following:
1. Design of a drainage system for the last 1,800.00 L.F. of roadway, west of
Congress Avenue.
Design of required improvements for the L.W.D.D. L-20 Canal.
Additional Palm Beach County design requirements that are not included in the
attached proposals-.
4. Permit applications.

This letter is to clarify the proposals, contracts, resolutions, etc. for professional
services for the above referenced project.
First, our original proposal to the City of Boynton Beach, dated March 28, 1994 in the
amount of $ 39,545.00 for the design of Miner Road from Lawrence Road to the
entrance of Chalet IV development was accepted by the City of Boynton.
Second, our proposal for the additional professional services dated November 4, 1994
in the amount of $ 7,400.00 was also accepted by the City of Boynton.
These two proposals gave a total contract amount of $ 46, 945.00 approved by the
City under Resolutions # R-94-87 and R-94-196.
Palm Beach County then requested a proposal to extend the design approximately
1,800 L.F. to Congress Avenue. Which is the referenced proposal dated February 6,
1995.
After negotiations with Palm Beach County, the total Lump Sum Fee agreed upon was
$ 57,495.00, an additional amount of $ 10,5~0.00 to be added to the original
contract amount of $ 46, 945.00.
Attached, please find copies of all the referenced correspondence for your review.
Your review and approval of the additional amount at your earliest convenience, will
be greatly appreciated.
