A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING
AND DIRECTING THE MAYOR AND CITY CLERK TO
EXECUTE A CONTRACT BETWEEN THE CITY OF
BOYNTON BEACH AND THE PALM BEACH COUNTY
HOUSING AUTHORITY, PROVIDING FOR
SUPPLEMENTAL LAW ENFORCEMENT AT AUTHORITY
LOCATIONS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Boynton Beach and the Palm Beach County Housing
Authority desire to enter into a contract to assist in creating a drug-free and crime-
free environment and to provide for the safety and protection of the residents in its
public housing developments; and
WHEREAS, the City Commission deems it to be in the best interests of the
citizens and residents of the City to enter into said Contract;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The City Commission of the City of Boynton Beach, Florida
hereby authorizes and directs the Mayor and City Clerk to execute a Contract
between the City of Boynton Beach and the Palm Beach County Housing Authority,
said Contract being attached hereto as Exhibit "A".
Section 2. This Resolution shall become effective immediately upon
passage.

On January 3, 1997, a draft comract regarding the above matter was sent to this office for review
and comment. Atter reviewing the contract and discussing minor issues With Beth Kinsey,
Director of Operations of the Palm Beach county Housing Authority, I submit to you the attached
revised contract. The date of the agreement and the term of the agreement (An. V) must be failed
in prior to .s. ubmission to the Commission. Please make sure this contract is placed On the January

CONTRACT FOR PROVISION OF SUPPLEMENTAL POLICE SERVICES
This Contract, made and entered into this day of January
1997, byand between the Palm Beach County Housing
A~thority (hereinafter called the "Authority'~ and :the City of
Boynton Beach, FL, (hereinafter called the l"Cig?) is for the
provision of specific police services associated with the
Authoritys security programs.
WHEREAS, the Authority desires to contract with the City for
additional services to assist in creating a dru3-free and crime-free
environment and to provide for the safety and protection of the
residents in its public housing developments, and
WHEREAS, the City, I~y and through its police department,
desires to assist in the effort by providing police
services at all Authority locations;
NOW THEREFORE, the A~thority and the City agree as follows:
ARTICLE I
Scope of Services
SECTION ONE: SERVICES PROVIDED BY THE CITY
The City agrees the services to be provided by assigned
personnel (police and dvilian) under this Contract are in addition
to baseline police services. The City agrees that it will not
reduce its current level of police sewices to the public housing
development, particularly in the areas of community polidng,
patrol, criminal investigations, records dispatch and special
operations.
The manner and method of performance of services is specified
in Article IV, Plan of Operations.
The duties and extent of services of the Assigned Personnel
shall indude, but shall not be limited to:
A. The Cityl by and through its police department, will provide
a minimum of one police officer to perform specialized patrols
to enforce all state and local laws and the Housing Authority Rules
in this Contract. Sworn officers shall at all times remain part of,
subject to and in direct relationship with the police department's
chain of command and under police department rules, regulations and
standard operating procedures.

B. The City agrees to assign police officers to targeted areas
during specific periods of time identified b,v the Authority
and agreed upon by the City as high crime or high worl<load
periods.
C. The City agrees that the police department will employ a
community policing concept and that the police department's
Community Policing Unit (or other unit whose priman/
responsibility is to develop and maintain communications with
residents) will assist in developing or enhandng crime
prevention pro,-ams in the public housing communities.
D. The Cityagrees to collect and provide workload data in public
housing developments.
E. It is further agreed that, to the extent necessary, the
assigned personnel will appear as witnesses in the
administrative grievance procedure, dvil dispossessory
hearings, or other civil or court proceedings where the issue
includes criminal or quasi-criminal conduct in or near public
housing developments involvin.~ any residents, member of a
residenfs household, or any guest of a resident or household
member.
F. V~rrthout limiting any of the foregoing, the City agrees that
with respect to the se~ces to be performed by any police
personnel in accordance with this Contract, the appropriate
police department Supervisor wilt meet with resident
leadership and management representatives of the Authority on
a routine basis for the purposes of reviewin3 the enforcement
and prevention efforts and planning for future changes or
modifications antidpated by this Contract. These meetin~.s
shall be held on a- monthly basis.
G. The City acknowled~es that a policy manual exists to regulate police
officers conduct and activities; all police officers have been
provided a copy of the policy manual; the department has a
signed receipt from each officer that heP, he has received and
understands the contents of the manual; and personnel have
been trained on the regulations and orders within the manual.
H.. The City.~ that it will provide the assigned personnel
with such basic equipment as may be necessary and reasonable
in order to allow the police officers to carry out the duties
antidpated under this Contract. Any additional automobiles,
motor vehicles, bicycles or other equipment requested by the
Authority will be furnished at the expense of and shall remain
the property of the Authority. The Authority and City may
mutually agree to. lease equipment or vehicles.

The AdministratiVe Liaison Officer will perform the fo owing
duties:
I. Coordinate the dissemination and processing of
police and security reports, provide supervisory
assistance, and coordinate in resolving problems or
in carryinj] out the provisions of this Contract;
Establish and maintain an ongoing line of
communication with beat/Zone Commanders a~ other
police personnel;
Prepare monthly progress reports and evaluations
of services requested and provided under this
Contract for review by the Executive Director, the
Police Chief, appropriate Deputy Chiefs and
Beat/Zone Commanders and identified community
representatives; and political leadership, e.g.
mayor and coundl members.
Initiate and monitor an on~oin~ line of communication
with resident leaders to effeclJvely employ the
community polidng concept and to address concerns
raised by community leaders in a timely manner.
5. Coordinate security workshops and. training seminars
for residents;
Assist or advise the planning and implementation of
other grant-funded security pro~-~ns within the
Authority; and
7. Establish a deady defined process for reporting
non-emergency criminal activities.

L. The City will at all times provide supervision, control and
direction ofwork activities and assi3nments of police
personnel, including disciplinary actions. It is expressly
understood the police department shall be responsible for
the compensation of the officers and all employee benefits, as
well as any injury to officers, their property, or the Citys
property while on the Authoritys property and acting within the
course and scope of their employment.
SECTION TWO: SERVICES PROVIDED BY THE AUTHORITY
The Authority, in assodation with the police department,
will provide training for residents, Authority
on-site management staff and the assigned police personnel with
workshops on community polidng and crime prevention issues
associated with public :housing. This may include, but not
be limited to, training in the following areas:
I. Crime prevention and securit7 responsibilities;
2. Community organization/mobilization against the causes of
and precursors to crime.
3. Drug awareness and control;
4. Orientating and familiarizing assigned officers with the public i~Ousing
Communities; and
5. Orientation to the con~-act, and compliance with
enforcement procedures and policies.
B. The ~ will provide the following

The Authority shall provide a written enumeration of the
reasons for the request for replacement of the assigned
personnel, including documentation and witnesses to the alleged
behaviors, acts or omissions.

The Authority will provide the City with Public Housing Police
Activity .Form(s) for assigned officers to complete. These
forms are notto replace police reports utilized by the City.
The Authority will provide the City'With the applicable
Authority rules and regulations for compliance with this
Contract.
ARTICLE II
Enforcement of Rules and Regulations
The City, through its police officers, is hereby empowered to
enforce the following Authority rules and r.e~ulations:
I. Unauthorized visitors in unoccupied structures of the
Authority shall be removed.
Unauthorized visitors creating disturbance or otherwise
interfering with the peacefu! enjoyment of lessees on
Authority property shall be removed.
Unauthorized visitors destroying, defaci_ng-or rerr,~yin~
Authority property shall be removed and/or criminal
enforcement actions shall be.taken.
With regard to the foregoing rules and regulations, the
police officers are hereby authorized tq3ive criminal
trespass warnings to any perSOns found in violation of said
rules or re~mJlations, i.e., to3Ne notice to any violators
that their ent~ on the property or premises is forbidden, and
to arrest or cause the arrest and prosecution of any violators,
when appropdate~
The City, through its police officers, is hereby empowered to
enforce the following Authority rule or re3ulation:
The resident and any visitor to Authority
property and premises shall refrain from, and
shall cause their households to refrain from
parking vehides in any area other than
parking designated by Authority management.
W~ regard to the ongoing rule or regulation, the Citys
officers are hereby authorized to have removed any and all
vehicles found parked in violation of said rule or regulation,
pursuant t.o established City procedure for. impoundi_ng
vehicles.
The City, through its police officers, is hereby empowered to
enforce such additional Amhority rules and re3ulations and
perform such other duties as shall be spedfied in any addenda
attached hereto or incorporated herein now or in the future:
Nothing herein contained shall be construed as permitting or
authorizing police officers to use any method or to act in any
manner ~n violation of law or of their sworn obligation as
police officers.
ARTICLE III
Communications, Reportip,~ and Evaluation
A. Communications
I. Access to Information
The City agrees that the Authority will have unrestricted
access to all public information not exempt from disclosure under
Chapter 119, Flodda Statutes, which in any way deals
with cdminal activity in any of the Authoritys
communities. It is further agreed that the City police
department will provide to the Autho..rity copies of such
inddent reports, arrest reports or other public
documents which document or substantiate actual or
potential criminal activity in or connected with the
public housing developments, This information will be
provided at no cost by the City police department ns requested.
The police deparlment will require all assigned personnel
(police offi. cers) to complete a rnont~l¥ I_o3 at the conclusion
of each shitt and for~rard the original report to the A~tho~

This will include, but not be limited to, data as follows:

The City and the Authority agree that any evaluation shall
include:

It is further agreed that, to facilitate the evaluation, the City will provide comparable
crime information for the City as a whole to fadlitate the
evaluation to include what proportion of activities City-wide
occur on Authority property.
ARTICLE IV
PLAN OF OPERATIONS
The City and the Authority shall prepare a detailed plan of
operations for use in combating drug-related crime. The
purpose of the plan is to specify the manner and method'of
performance by which each of the services identified is to be
provided.
The plan of operations will minimally spedfy the following:
I. Service goals and minimum performance criteria (e.g. a
definition of what is to be achieved and the expected
benefits or outcomes that will be derived);
2. Staffing levels;
3. Responsibilities of key personnel;
4. Organization and resources, to indude personnel,
equipment, in-kind support, etc.;
5. Hours ofoperation, to encompass schedules of major tasks
and activities; and
6. Community irrterface to evidence the methodology by which
resident involvement will be ~ained and maintained dudng
the term of this Contract.
The plan of operations will be prepared for review and
acceptance within thirty (30)-days of the date of execution of
this Contract by both parties. It is understood that the
Authority may request reasonable modification to the initial
plan of operations as its deems appropriate. The Authority
must approve the plan in order for payment to begin.
If during the term of the Contract either party desires to
amend the scope of the Plan of operations, either party may
request an amendment in writing. The Executive Director and
the Chief of.Police shall make final determinations re~ardin3
the establishment of an amendment to the plan of operations.
ARTICLE V
Term of Contract
The term of this Contract shall be for two (2) years beginning
on January , 1997 and ending january , 1999.
ARTICLE VI
Compensation to the City
All compensation is to be made on cost reimbursement basis. The
Authority will reimburse the City for services specified in
this Contract in an amount not to exceed ninety-ninethousand
five hundred and seventy eight ($99,578), inthe following
expense cate3ories:

The ~shall reimburse the police department on a
monthly I~sis, upon receipt of performance of'the proposed
services and evidence of authorized expenditures,
The percent of overtime authorized under this Contract for
court appearances or other hearin~ is limited by the total
salary in the approved budget. Overtime exceeding the
budgeted salary amount is to be borne by the City.
The City shall provide the following d~umentation in
requesting reimbursement:
All requests for reimbursement are subject to the approval of
the Executive Director, or the officials desi3nee, and the
Authority shall thereafter make payment of the approved amount
within thirty (30) days of receipt of the request for
reimbursement.
ARTICLE VII
Termination
The Authority may terminate this Contract upon thirty (30) days
written notice to the City. Such notice
shall be delivered by Certified Mail, Return Receipt
Requested to the address spedfied in Article VIII.

Notices
Any notices required pursuant tothe terms of this Contract

Construction of Laws
This Contract is made and entered into by the City. Any and
all questions of law arising hereunder shall be construed in
accordance with the laws of the State in which the City is located.

personnel in accordance with this Contract, the appropriate
police department Supervisor will meet with resident
leadership and management representatives of the Authority on
a routine basis for the purposes of reviewin3the enforcement
and prevention efforts and planning for future changes or
modifications antidpated I~y this Contract. These meetings
shall be held on a monthly basis.
The City acknowledges that a policy manual exists to regulate police
officers conduct and activities; all police officers have been
provided a copy of the policy manual; the department has a
signed receipt from each officer that he/she has received and
understands ~ contents of the manual; and personnel have
been trained on the regulations and orders within the manual.
The C~aJ~'ees that it will provide the assigned personnel
with such basic equipment as may be necessary and reasonable
in order to allow the police officers to carry out the duties
anticipated under this Contract. Any additional automobiles,
motor vehicles, bicycles or other equipment requested by the
Authority will be furnished at the expense of and shall remain
the property of the Authority. The Authority and City may
mutually agree to lease equipment or vehicles.

I. The police department will provide at a minimum sixteen (I 6)
hours of trainin3 on community relations and interpersonal
communications skills.
J. The City a~ees to provide, at no cost to the Authority,
criminal background checks of proposed applicants
for public housing. This information will be provided in a
manner consistent will all applicable National Crime
Information Center or State laws and rep, ulations.
K. The police department shall designate a command officer as the
Administrative Liaison Officer, who will work in concert with
the Executive Director of the Authority or that official's
designate.
The Administrative Liaison Officer will perform the following
duties:
I. Coordinate the dissemination and processing of
police and secur'~ reports, provide supervisory
assistance, and coordinate in resolving problems or
in carryin~ out the provisions of this Contract;

Establish and maintain an ongoing line of
communication with beat/Zone Commanders and other
police personnel;
Prepare monthly progress reports and evaluations
of services requested and provided under this
Contract for review by the Executive Director, the
Police Chief, appropriate Deputy Chiefs and
Beat/Zone Commanders and identified community
representatives; and political leadership,
mayor and coundl members.
Initiate and monitor an on3oin3 line of COmmunication
with resident leaders to effectively employ the
comrntmity polidng concept and to address concerns
raised by community leaders in a timely manner,
5. Coordinate security workshops and trainin~ seminars
for residents;
Assist or advise the planning and implementation of
other grant-funded security pro~ms within the
Authority; and
7. Establish a dearly defined process for reporting
non-emergency criminal activities.

L. The City will at all times provide supervision, control and
direction, c/work activities and assi,~nments of police
personnel, in_duding disciplinary actions. It is expressly
understoo8 the police department shall be responsible for
the compensation c/the officers and all employee benefits, as
well as any injury to officers, their property, or the Ciys
~)roperty while on the Authoritys property and acting within the
course and scope of their employment.
SECTION TWO: SERVICES PROVIDED BY THE AUTHORITY
The Authority, in association with the police department,
will provide training for residents, Authority
on-site management staff and the assi3ned police personnel with
workshops on community polidng and crime prevention issues
associated with public housing. This may include, but not
be limited to, training in the following areas:
I. Crime prevention and security responsibilities;
2. Community organization/mobilization against the causes of
and precursors to crime.
3. Drug awareness and control;
4. Orientating and familiarizing assi,~ned officers with the public housing
Communities; and
5. Orientation to the contract, and compliance with
enforcement procedures'and polities.
B. The Authority will .provide the following in-kind
accommod~ons, services and equipment:

I. Accommodations - The Authority will provide suitable
space to be used as a satellite office at each site
- targeted for additional police services.
2. Services- Each satellite office will be supplied with
utilities (water, heat, electricity) and routine and
extraordinary maintenance by personnel of the Housing
Authority.
3. Equipment - Each satellite office is to be supplied with
any other, additional equipment mutual~ agreed upon in
connection with the performance of this Contract.
4, Modification/Damage - The Authority will make reasonable
modifications to the accommodations provided in order to
meet the City's operational needs._ Ap_¥ da _rT~ages to the unit or
equipment which are in excess of normal wear for the particular item or
accomodation, and which d _ar~a_ ge is caused by the. city or_.its employees
shall be repaired or replaced by the City at the discretion of the Authority.
C. The Authority shall provide a_ quarterly assessment of the
results achieved, as measured against the performance
objective specified in the Plan of. Operations listed in
Article IV of this Contract.
D. The ..Authority shall rese .rve tl3_e .right to reasoQablY request
the police department to replace any assigned personnel for
the following reasons:
I. Neglect or non-performance of duties;
2. Disorderly conduct, use of abusive or offensive or fighting;
3. Cdminai action;
4. Selling, consuming, possessing or being under the
influence .of intoxicants, i.nduding alcohol or ill.egal
substances, while on assignment to the Authority;
5. Inadequate punctuality or attendance; Or
6. Substantiated complaints form public housing residents or
management.
The Authority shall provide a written enumeration of the
reasons for' the request for replacement of the assigned
personnel, including documentation and witnesses to the alleged
behaviors, acts or omissions.

The ~ will provide the City with Public Housing Police
Activity ..Fc?n(s) for assigned officers to complete. These
forms are notto replace police reports utilized bythe City.
The Authority will provide the City with the applicable
Authority rules and regulations for compliance with this
Contract.
ARTICLE II
Enforcement of Rules and Regulations
The City, through its police officers, is hereby empowered to
enforce the following A~_or'm/rules and r.egulations:
I. Unauthorized visitors in unoccupied structures of the
Authority shall be removed.
Unauthorized visitors creating disturbance or otherwise
interfering with the peaceful_enjoyment of lessees on
Authority property shall be removed.

Wrth regard to the foregoing rules and regulations, the CEys
police officers are hereby authorized to_give criminal

that thei~ entry on the property or premises is forbidden, and
to arres~ or cause the arrest ..and prosecution of any violators,
when approp~.
The City, through its police officers, is hereby empowered to
enforce the following.Authority rule or .regulation:
The resident and any visitor to Authority
property and premises shall refrain from, and
shall cause their households to refrain from
parking vehicles in any area other than
parking designated by Authority management.

Nothing herein contained shall be construed as permitting or
authorizing police officers to use ~¥ method or to act in any
manner in violation of law or of their sworn obligation as
police officers.
ARTICLE III
Communications, .Reportip,~ and Evaluation
A. Communications
I. Access to Information
The City agrees that the Authority will have unrestricted
access to all public information not exempt from disclosure under
Chapter I 19, Florida Statutes, which in any way deals
with criminal activity in any of the Authoriys.

It is further agreed that, to facilitate the evaluation, the City will provide comparable
crime information for the City as a whole to fadlitate the
evaluation to include what proportion of activities City-wide
occur on Authority property.
ARTICLE IV
PI_AN OF OPERATIONS
A. The City and the Authority shall prepare a-detaileq plan of
operations for use in combating drug-related crime; The
purpose of the plan is to specify the manner and method of
performance by which each of the services identified is to be
provided.
The plan of operations will minimally specify the following:
I. Service goals and minimum performance criteria (e.g. a
definition of what is to be achieved and the expected
benefrts or outcomes that will be derived);
2. 'Staffing levels;
3. Responsibilities of key personnel;
4. Org~i2~ion and resources, to indude personnel,
equi~ in-kind supporL etc.;
5, H~ot'operation, to encompass schedules of major taslcs
6. Comrnun~ interface to evidence the' methodology by which
resident involvement will be gained and maintained during
the term of this Contract.
The plan of operations will be prepared for review and
acceptance within thirty (30)-days of the date of execution of
this Contract by both parties. It is understood that the
Authority may request reasonable modification to the initial
plan of opera_ 'ons as its deems appropriate. The Authority
must approve 1~ plan in order for payment to begin.
If during the term of the Contract either party desires to
amend the scope of the plan of operations, either party ma),
request an amendment in writing. The Executive Director and
the Chief of Police shall make final determinations re~ardin3
the establishment of an amendment to the plan of operations.
ARTICLE V
Term of Contract
The term of this Contract shall be for two (2)years beginning
on January , 1997 and endingJanuary , 1999.
ARTICLE V1
Compensation to the City
All compensation is to be made on cost reimbursement basis. The
Authority will reimburse the City for services sped~ed in
this Contract in an amount not to exceed ninety-nine-thousand
five hundred and seventy eight ($99,578), in. the following

The ~ shall reimburse the police departrnent on a
monthl~ basis, upon receipt of performance of the proposed
services and evidence of authorized expenditures.
The percent of overtime authorized under this Contract for
court appearances or other hearin3s is limited by the'total
salary in the approved budget. Overtime e~eeding the
budgeted salary amount is to be home by the City.
The City shall provide the following documentation in
requesting reimbursement:
Copies of Certified Payroll Time Reports documenting
names, employee identification, hours worked in public
housin~ cl_evelopments, supervisory approval and
verification of necessit7 for any overtime worked.
All requests for reimbursement are subject to the approval of
the Executive Director, or the official's desi3nee, and the
Autho~y shall thereafter make payment of the approved amount
within thirty (30) days of receipt of the request for
reimbursement.
ART1CLE VII
Termination
The Author~ may terminate this Contract upon thirty (30) days
written notice to the City. Such notice
shall be delivered by Certified Mail, Return Receipt
Requested to the address spedfied in Article VIII.
The City may terminate this Contract upon thirty (30) da~ written

Notices
Any notices required pursuant to the terms of this Contract

Construction of Laws
This Contract is made and entered into by the City. Any and
ail questions of law arising hereunder shall be construed in
accordance with the laws of the State in which the City is located.
