R08- 0 18 2 3 A RESOLUTION OF THE CITY OF BOYNTON 4 BEACH, FLORIDA ELECTING TO USE THE 5 UNIFORM METHOD OF COLLECTING NON-AD 6 VALOREM SPECIAL ASSESSMENTS LEVIED 7 WITHIN THE INCORPORATED AREA OF THE CITY; 8 STATING A NEED FOR SUCH LEVY; PROVIDING 9 FOR THE MAILING OF THIS RESOLUTION; AND 10 PROVIDING FOR AN EFFECTIVE DATE. 11 WHEREAS, the City of Boynton Beach, Florida (the "City") is contemplating the 12 imposition of special assessments for the provision of fire protection services within the City 13 beginning with Fiscal Year 2008-09; and 14 WHEREAS, the City intends to use the uniform method for collecting non-ad 15 valorem special assessments for the cost of providing fire protection services to property 16 within the incorporated area of the City beginning with Fiscal Year 2008-09 as authorized by 17 section 197.3632, Florida Statutes, as amended, because this method will allow such special 18 assessments to be collected annually commencing in November 2008, in the same manner as 19 provided for ad valorem taxes; and 20 WHEREAS, the City held a duly advertised public hearing prior to the adoption of 21 this Resolution, proof of publication of such hearing being attached hereto as Exhibit A. 22 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF 23 THE CITY OF BOYNTON BEACH, FLORIDA, THAT: 24 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 25 being true and correct and are hereby made a specific part of this Resolution upon adoption 26 hereof. Commencing with the Fiscal Year beginning on October 1, 2008, and 3 with the tax statement mailed for such Fiscal Year, the City intends to use the uniform 4 method of collecting non-ad valorem assessments authorized in section 197.3632, Florida 5 Statutes, as amended, for collecting non-ad valorem assessments for the cost of providing 6 fire protection services within the City beginning with Fiscal Year 2008-09. Such non-ad 7 valorem assessments shall be levied within the incorporated area of the City. A map and 8 legal description of such area subject to the assessment is attached hereto as Exhibit B. 9 Section 3. The City hereby determines that the levy of the assessments is needed 10 to fund the cost of fire protection services within the incorporated area of the City beginning 11 with Fiscal Year 2008-09. 12 Section 4. Pursuant to section 197.3632, Florida Statutes, the Palm Beach 13 County Property Appraiser and the Palm Beach County Tax Collector have agreed that the 14 City may have until March 1, 2008 to adopt this Resolution, such agreements being attached 15 hereto as Exhibit C and incorporated herein by reference. 16 Section 5. Upon adoption, the City Clerk is hereby directed to send a copy of this 17 Resolution by United States mail to the Florida Department of Revenue, the Palm Beach 18 County Tax Collector, and the Palm Beach County Property Appraiser by March 10,2008. 19 Section 6. This Resolution shall be effective upon adoption.
