A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AUTHORIZING AND DIRECTING THE MAYOR
AND CITY CLERK TO EXECUTE A SPECIAL
WARRANTY DEED CONVEYING PROPERTY
AS PART OF THE CITY'S INFILL
CONSTRUCTION PROGRAM TO ERIC
JOHNSON AND KIMBERLY JOHNSON; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Eric and Kimberly Johnson have been approved for a
~ortgage as participants in the City of Boynton Beach Infill Construction
3rogram; and
WHEREAS, Eric and Kimberly Johnson have selected a city-owned lot
n the Cherry Hills Subdivision and desire to build a single family home on
said lot; and
WHEREAS, the construction of single-family housing in existing
subdivisions throughout the City is encouraged for the purpose of community
· evitalization and increased taxable value; and
WHEREAS, the City Commission of the City of Boynton Beach, based
upon staff recommendation, finds it to be in the best interests of the
community and its residents to convey the below-described property to Eric
and Kimberly Johnson, for the purpose of constructing a single family home.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
3F THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The City Commission of the City of Boynton Beach,
Florida does hereby authorize and direct the Mayor and City Clerk to execute
a Special Warranty Deed conveying certain property in Cherry Hills
Subdivision, to Eric and Kimberly Johnson, as part of the City's Infill
Construction Program. A copy of the Special Warranty Deeds are attached
hereto as Exhibit '%".
Section 2.

Corrective/Corrected Warranty Deeds
Attached please find copies of Special Warranty Deeds for two (2) City of Boynton
Beach Infi[I Housing Program cases, that were awarded property from the city on which
to build single-family homes. The legal descriptions on both were incorrect and needed
to be re-written and executed. Having done so, I am forwarding these to you so that they
may be attached to their corresponding Resolutions as Exhibits "A". Should you have
any questions regarding this matter please feel free to contact me.

SPECIAL WARRANTY DEED
THIS INDENTURE, made this ~ day of April, 1999, between THE CITY OF
BOYNTON BEACH, FLORIDA, a municipal corporation, (hereinafter referred to as
"Grantor") and ANDRA JACKSON, whose address is Palm Beach County, Florida
(hereinafter referred to as "Grantee").
WITNESETH:
That said Grantor, for and in consideration of the sum of TEN ($10.00)
DOLLARS, and other good and valuable considerations to Grantor in hand paid by
Grantee, the receipt whereof is hereby acknowledged, has granted, bargained and sold
to the Grantee, and Grantee's heirs and assigns forever, the following described land,
situate, lying and being in Palm Beach County, Florida, to wit:
Lots 50, 51 and the west 20' of Lot 52, Cherry Hills, as
recorded in Plat Book 4, Page 58 of the Public Records of
Palm Beach County, Florida.
Grantor does hereby warrant title to the land, and will defend the same against
the lawful claims of all persons claiming by, through, or under the Grantor, but against
none other.
GRANTEE covenants that the real property conveyed by this instrument must be
used to benefit Iow and moderate income persons and/or families, as those terms are

defined by the U.S. Department of Housing and Urban Development and Palm Beach
County, for a pedod of twenty (20) years from the date he~'eof. In the event of a breach
of this covenant, title shall revert to GRANTOR.
