RESOLUTION VACATING CERTAIN PUBLIC UTILITY
EASEMENT SET FORTH UPON THE PLAT OF BOYNTON
INDUSTRIAL PARK, A SUBDIVISION OF THE CITY OF
BOYNTON BEACH, FLORIDA.
WI-IEREAS, BOYNTON INDUSTRIAL PARK, INC., a Florida
corporation, the owner of certain land over which a certain eight foot (8')
publicly dedicated utility easement is presently located, has made application
to the CITY OF BOYNTON BEACH, FLORIDA, for the adoption of a resolutio~
vacating and abandoning the interest of the public in and to subject easement,
same being more particularly described hereinafter; and
WI-IERE~, it appears that no public utilities have previously been
laid in subject easement, nor has same in fact been utilized by the public; and
WHEREAS, it appears that the owner of subject property is pre-
sently faced with a hardship due to the utilization by the State Road Depart-
ment of the State of Florida, of a portion of the property herein involired
which abuts and fronts Boynton Road, thereby reducing the size of subject
lots to such an extent that the utility of same are impaired; and
WHEREAS, it appears that after abandonment of subject easement
there will still remain a publicly dedicated easement of twelve feet (12')
adjacent to the area herein concerned, and that there appears to be no other
reason why subject utility easement should not be vacated for the benefit of
abutting property owner;
NOW, THEREFORE, be it resolved by the City Council of the
CITY OF BOYNTON BEACH, FLORIDA, as follows:
That certain eight fooI (8') public utility easement over and
across the north eight feet of Lots 1, 2, 3 and 4, of
BOYNTON INDUSTRIAL PARK, a subdivision of the
City of Boynton Beach, Florida, according to the Plat
thereof on file in the office of the Clerk of the Circuit
Court in and for Palm Beach County, Florida, in Plat
Book 25, page 232
is hereby vacated, nullified, closed and abandoned and all right and interest
of the general public in and to subject area is hereby relinquished.
