64-JRESOLUTION No. 64- J A resolution authorizing and directing the proper municipal officials to enter into an agreement with Palm Beach County authorizing the County to act in behalf of and represent the CITY OF BOYNTON BEACH, FLORIDA, in the development of a transportation plan for Palm Beach Cour WHEREAS, the Municipality deems it advisable to enter iht an agreement with Palm Beach County, authorizing the County to act in be- half of and represent the CITY OF BOYNTON BEACH, FLORIDA, in the development of a transportation plan for Palm Beach County~ NOW, THEREFORE, be it resolved by the City Council of the CITY OF BOYNTON BEACH, FLORIDA: Section 1: The City Council of the CITY OF BOYNTON BEACH, FLORIDA, does hereby authorize and direct the proper City officia to enter into an agreement, a true copy of which is attached hereto and made a part hereof, with Palm Beach County authorizing the County to act in behat of and represent t he City of Boynton Beach, Florida, in the development of a transportation plan for Palm Beach County. ' ~ ' ~ ~__ Mayor .. :' ~b~ncilman ~ity Clerkf - ~- ~Councilm~ Councilman COUNTY - MUNICIP~L MEM©RANDUM OF AGREEMENT THIS AGREEMENT, made and entered into this day of , 1964, by and between the COUNTY OF PALM BEACH, FLORID~ hereinafter called the"Count~; and the CITY OF BOYNTON BEACH, FLORIDA, an incorporated municipality, hereinafter called "City"; WITNESSETH: WHEREAS, Section 9 of the Federal-Aid Highway Act of 1962, as amended, promulgates the declaration that it is in the national interest to encourage and promote the transportation system embracing modes of trans- portation to serve the states and local communities efficiently and effectively; and 'WHEREAS, after July 1, 1965, ttae Bureau of Public Roads shall not approve any pro.am for Federal-Aid Highway projects in any urban area of more than ~50, 000 population, unless such projects are based on a con- tinuing, comprehensive transportation planning process carried on coopera- tively by states and local communities; and WHEREAS, tiae instructional memorandum of the United States Department of Commerce, Bureau of Public Roads, No. 50-2-63, dated March 2'/, 1963 indicates that the'~est Palm Beach Urbanized Area" as listed in Table 23, U.S. Census af Population - 1960, General Social and Economic Characteristics, United States Summary, U.S. Bureau of the Census, is one of the areas referred to in the 1962 ~ct; and WHEREAS, THE CITY OF BOYNTON BEACH, FLORIDA, by resOlu~n attached hereto and made a part hereof dated the ~ .... day of C~-~--._. 0 1964, has requested the County to represent The City in the fulfillment of the obligations devolvinl[ upon The City in connection with said studies; and WHEREAS, the County is willing to act in the capacity of agent and coordinacting entity in the developing and evaluation af/nformation relating to the following factors: 1. That the economic, population, and land use elements be c(~nsidered fully; 2. That estim~tes be made of the future demand8 for both public and private movement of both people and goods; 3. That terminal facilities and traffic control systems be included in the planning; and 4. That the entire area within which the forces of develop- ment are iterrelated should be included - not just as it exists now, but as it is expected to be urbanized within the forecast period; NOW, THEREFORE, THIS AGREEMENT WITNESSETH: That in consideration of the premises and the covenants hereinafter set forth to be kept and performed by each of the parties hereto, it is hereby mutually covenanted and agreed as follows: 1. The County and The City shall participate in a joint project, designated as "Palm Beach County Urban Transportation Study" in accordance with the Instructional Memorandum of the United States Depart- ment of Commerce, Bureau of Public Roads, No. 50-2-63, dated March 27, 1963. 2. For the 0urpose of this project the City hereby appoints and designated the County to represent it as a coordinating entity between !he State [icad Department and The City to process the corr~prehensive character of the program outlined ~bove. 3. The exercise of the authority granted hereby to the County shall entail no expense to The City.
