70-ZRESOLUTION NO.
A RESOLUTION APPROVING DESIGNATION OF
INTERSTATE 95, STATE ROAD 9, AS A LIMITED
ACCESS FACILITY
WHEREAS, the highway authorities of the state, counties,
cities, and villages acting alone or in cooperation with each other or with
any federal, state, or local agency of any other state having authority to
participate in the construction and maintenance of highways, are hereby
authorized to plan, designate, establish, regulate, vacate, alter, improve,
maintain, and provide limited access facilities for the public use wherever
such authority or authorities are of the opinion that traffic conditions,
present or future, will justify such special facilities; and
WHEREAS, the Secretary of Transportation has heretofore
designated Interstate 95, State Road 9, as a limited access facility; and
WHEREAS, a portion or all of said state road lies within
boundaries of the City of Boynton Beach, County of Palm Beach, Florida; and
WHEREAS, such limited access facility shall not be or become
a part or link of a municipal connecting-link road as defined by the highway
code; and
WHEREAS, it is the finding of the City Council of the City of
Boynton Beach, that traffic conditions, present or Cuture, will justify such
special facilities:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That said special facility designated as Interstate
95, State Road 9, County of Palrn Beach, Florida, is hereby approved and
consented to, that a copy of this Resolution shall be spread upon the minutes
of this meeting and a certified copy hereof furnished to the State of Florida
Department of Transportation.
