76-WRESOLUTION NO. 76'-W A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA, DETERMINING NECESSITY OF PAVING N.W. 7ih COURT FROM N.W. 4th AVENUE TO A POINT 200 FEET NORTH OF N.W. 10th AVENUE: IN- DICATING TOTAL ESTIMATED COST OF: PROPOSED IMPROVEMENT AND PORTION THEREOF PAYABLE BY SPECIAL ASSESSMENT: SETTING TIME AND PLACE FOR PUB LIC HEARING OF OBJECTIONS TO PROPOSED' IMPROVEM]E NT: A ND ES TAB LISHING METHOD BY WHICH SPECIAL ASSESSMENT SHALL BE IMPOSED AND PAID. WHEREAS, the City Council of the City of Boynton Beach, F[0rida, pursuant to the Charier of said City, deems it necessary for the public inter- est that the public streets of said City, more particularly described herein- after, be improved by being constructed, repaired, resurfaced and/or rebuilt and WHEREAS, the City Council of said City heretofore, by Resolution No. 76-0, has, according to [aw, required the City Engineer to prepare an estimated cost of such improvements and to prepare p[an~ and specifications covering the construction of same, as we[[ as a preliminary assessment roll, setting forth those lots to be assessed and the amount of the approximate assessment against each such lot; and WHEREAS, the said City Engineer has completed such req and said plans and specifications and preliminary assessment roll are now file in his office; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, as follows: 1. That the public streets hereinafter described shah be construc- and/or rebuilt over the publicly dedicated right-of-way thereof, in accordane with plans and specifications as required by laws of the City of Boynton Beach, Florida, now on file in the office of the City Eflgineer, said streets being more particularly described as follows: Thai portion of N.W. 7th Court lying between N.W. 4th Avenue to a point 200 feet north of N.W. 10th Avenue containing approximately 4, 017.96 front feet. Each abutting property owner along the above proposed i~mprove ments shah be assessed on a front footage basis, charging said owner his proportionate share as divided by the iota[ improvement cost. Any such assessment may be paid within ninety (90) days from the date of confirmal~on thereof, without interest. Thereafter, ail assessments shah be payable in three (3) equal consecutive annual installments, together with interest at rale of eight (8%) percent per annum, from lhe expiralion of the said ninety (90) days, in each of the succeeding years at the time or times in each year al which genera[ municipal taxes are payable, provided that any assessment may together with ir~terest accrued thereon to the be paid at any time before due, date of payment.
