A RESOLUTION OF THE CITY OF BOYNTON BEACH,'
FLORIDA, VACATING AND ABANDONING AN INGRESS,
EGRESS AND UTILITY EASEMENT WITHIN TRACT B
OF CHARTER WORLD AS RECORDED IN PLAT BOOK
31, PAGE 21, PUBLIC RECORDS OF PALM BEACH
COUNTY, FLORIDA.
WHEREAS, the City Council of the City of Boynton Beach, Florida,
has initiated proceedings for vacating and abandoning the ingress, egress and
utility easement located on certain property within Tract B of Charter World,
as recorded in Plat Book 31, Page 21, Public Records of Palm Beach County,
Florida, as is more fully described hereinafter; and
WHEREAS, said abandonment has heretofore been considered by the
Planning and Zoning Board of the City of Boynton Beach, Florida, and a
favorable recommendation has been rendered in connection therewith; and
WHEREAS, all affected public utilities have been contacted for their
recommendations in connection with said proposed abandonment, and their
recommendations have been received; and
WHEREAS, said proposed abandonment is deemed to be reasonable
and in the best interests of the inhabitants of the City of Boynton Beach,
Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That the easement for ingress, egress and utility put -
poses, lying in and upon the real property described in the annexed Exhibit A
which is hereby incorporated herein by reference, located in Palm Beach
County, Florida, be and is hereby vacated and abandoned and the subject area
is herein returned to acreage for purposes of taxation.
