77-YYRESOLU ¢ON NO. 77 yy A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, VACATING AND ABANDONING CER- TAIN PORTION OF S. W. 28 A%rENUE WITHIN SAID CITY OF BOYNTON BEACH, FLORIDA. WHEREAS, the City Council of the City of Boynton Beach, Florida has received a petition from the owners of land described hereinafter for the adoption of a resolution vacating and aban- doning a portion of S. W. 28 Avenue within said City; and WHEREAS, subject abandonment has heretofore been con- sidered by the Planning and Zoning Board of the City of Boynton Beachr Florida, and a favorable recommendation has been rendered in connection therewith; and WHEREAS, after thkDrough public investigation and public hearing of said abandonment, it appears that no hardship will be occasioned by said abandonment, that said abandonment will be for the best interests of the general public, and that no valid rea- son exists why same should not be vacated; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That portion of S. W. 28 Avenue, more par- ticularly described in legal description attached hereto and mad, a part he~eof, is hereby vacated and abandoned, and ~ai~ area is hereby returned to acreage for purposes of taxation. Beginning at the Northeast corner of Lot 31, Block 10, Golf View Harbour 2nd Section, as recorded in Plat Book 27, page 46, public records of Palm Beach County, Florida; thence due Nest {assumed), along the N~rth line of said Lot 31, a distance.of 65.46 feet to the point of curvatgre of a curve concave to the Southeast; thence Westerly 9long the arc of said curve, having a radius of 25.00 feet and a central angle of 38° 10' 36", a dis- tance o£ 16.66 feet; thence N. 1° 55' 20" E., a distance of ~3~ feet; thence due East, adistance of 55.86 feet to a point in a curve concave to the Northeast, whose local tangent bears S. SO° E.; thence Southeasterly, along the arc of sai~ curve, having a radius of 50.00 feet and a central angle of 60 , a distance of 52.36 feet; thence due West, a distance of 20 37 feet to the Point of Beginhing aforedescribed. ' The above described parcel subject to a utility easement over the South 12.00 feet thereof. Also the North 13.00 feet of the West 40.00 feet of the above -described parcel was abandoned in the City of Boynton Beach Resolution No. 75-LLL. Description of that portion of Southwest 28th Avenue to be abandoned. That portion being platted in Tract 1, Golf View Harbour 3rd Section, but never abandoned by ressolution. Commence at the Northeast corner of Lot 31; Block 10, Golf View Harbour 2nd Section, as recorded in Plat Book 27, page 46, public records of Palm Beach County, Florida; thence due East, along the l-Jorth line of Lot 30, Block 10, Golf View Harbour 2nd Section, a distance of 20.37 feet to the point of curvature of a curve concave to the Northeast; thence Northwesterly, along the arc of said curve, having a radius of 50.00 feet and a central angle-of 60°, a distance of 52.36 feet to the Point of Beginning of the parcel t9 be herein described; thence continue along the arc of said curve ~l~aving a radius of 50.00 feet and a central 'angle of 30°'' a distance of 26.18 feet; thence due West, a distance of 9.42 feet; thence S..1° 55' 20" W., a distance of 25.01 feet; thence due.East, a distance of 16.95 feet to the Point of geginning.aforedescribed.
