84-MA RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDAr FIXING THE
TIME AND PLACE AT WHICH OWNERS OF PROPERTIES
TO BE SPECIALLY ASSESSED FOR THE CONSTRUCTION
AND/OR REBUILDING OF APPROXImaTELY 180 FEET
OF SOUTHEAST THIRD STREET, LYING NORTH OF
SOUTHEAST TWENTY-FIRST AVENUE ~Y BE HEARD;
AND FOR OTHER PURPOSES.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCI~
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: The City Council of the City of Boynton
Beach, Florida, by this Resolution, fixes the time and vlace
at which the owners of the property to be specially assessed by
the City of Boynton Beach, Florida, for the construction and/or
rebuilding of approximately 180 feet of S.E. Third Street, lying
north of S.E. Twenty-first Avenue, as set forth in Resolution
No. ~-~ , or any other person interested therein, may
appear before the City Council and be heard as to the propriety
and advisability of making such improvements, as to the cost
thereof, as to the manner of payment therefor, and as to the
amount thereof to be assessed against each property so improved.
Section 2: On the ~ day of--~~//~. ,
1984, at ~,'~O o'clock p.M., in the City Council Chambers,
City Hall, 120 E. Boynton Beach Blvd., Boynton Beach, Florida, the
City Council will hear the owners of the property to be assessed
for the above referenced improvements as set forth in
Resolution No. ~Q~, and all other persons interested therein,
as to the propriety and advisability of making such improvements,
as to the cost thereof, as to the manner of payment therefor,
and as to the amount thereof to be assessed against each property
so improved. An assessment roll has been completed and filed
with the City Council showing the lots and lands assessed,
the amount of the assessment against each lot or parcel of land,
the number of installments into which the assessment is divided
and the estimated cost of such improvement.
Section 3: The City Clerk is hereby directed to give
at least ten (10) days notice in writing of the hearing to be
held

o~c!ock A.M., in the City Council Chambers, City Hall, 120 East
Blvd,Boynton Beach, Florida, to said property owners
affected by this Resolution and Resolution No. ~-~, being each
property owner shown on the assessment roll referred to above,
by mailing a copy of such notice to each of the property owners
at his las~ known address. The names and addresses of such
property owners are to be obtained from the records of the Palm
Beach County Tax Assessor, or from such other source as the City
Clerk deems reliable. The proof of such notice shall be made by
affidavit of the City Clerk and shall be filed in the office of
the City Clerk.
Section 4: Notice of the time and place of such
hearing referred to above shall be given by two publications, one
week apart, in a newspaper of general circulation in the City of
Boynton Beach, Florida. Notice shall be placed in the newspaper
by the City Clerk, who shall provide that the last publication
shall be at least one week prior to the date of the hearing set
forth above. The notice to be published shall describe the area
to be improved and advise all persons interested that the
description of each property assessed in the amount to be assessed
to each piece or parcel of property may be ascertained at the
office of the City Clerk, City Hall, 120 E. ~Boynton Beach Blvd.,
Boynton Beach, Florida. The City Clerk shall secure an affidavit
of the publisher showing proof of publication, which shall be
filed with the City Clerk.
Section 5: At the time and place referred to above
for hearing, the City Council shall meet as an equalizing board
to hear and consider any and all complaints as to such special
assessments, and shall adjust and equalize the said assessments
on the basis of justice and rights, and when so equalized, shall
approve such assessment by resolution of the City Council.
Section 6: This Resolution shall become effective
immediately upon its passage.

WHEREAS, tile City of Boynton Beach has accepted a
performance bond in the amount o~ $25,000 for lake excavation and,
WHEREAS, said lake excavation has been completed
satisfactorily and,
WHEREAS, the City holds bonds for Plat II in the
amount of $321,411.65 and Plat III in the amount of $228,967.40
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
The City Council in the City of Boynton Beach releases
Bond No. 965 33 9.5 in the amount of $25,000.
